NEW TWIST as Tycoon Ham Now Drags Kabaka to Court

Youthful Kampala city tycoon Hamis Kiggundu aka Ham has sued Buganda Kingdom monarch Ronald Muwenda Mutebi II over the controversial issue of the ownership of land in Kigo. Months ago, Ham seemed to have given up on the 140 acres of land in Kigo.

But the businessman has now made a u-turn and dragged the Kabaka to court over the same piece of land. Besides the Kabaka of Buganda, the other respondent is the Commissioner of Land Registration at the Ministry of Lands, Housing and Urban Development.

In an appeal filed before the Land Division of the High Court, Ham Kiggundu, through his lawyers of Muwema and Co Advocates, is seeking orders for the nullification of a decision by Baker Mugaino, the Commissioner in charge of Land Registration at the Ministry of Lands, who riled that the tycoon was an illegal occupant of the land in question and that Buganda Kingdom was the rightful owner of the land in Kigo.

In September 2022, Commissioner Mugaino issued orders cancelling four titles of the said land which Ham was claiming. In Magaino’s ruling, the issuance of the certificates of titles comprised in Kyadondo Block 273 Plots 23974, 23975, 23976, and 23977 subdivided from plot 23720 was illegal.

Mugaino further ruled: “It is questionable how a professional survey could have been undertaken to create on overlay on an already existing title. Without any doubt, such survey process was flawed and an illegality that resulted in double titling. It is therefore my finding that the freehold titles owned by Kiham Entreprises Ltd overlap the Mailo titles owned by Kabaka of Buganda, which is illegal.”

In March 2022, Tycoon Ham seemed to have either given up on the case or lost interest in the same and made it clear that he would not continue his battles against the Kabaka of Buganda, a kingdom to which he belongs.

“I am Kiggundu Hamis Kiggundu and I am a Muganda by tribe. Buganda is us and we are Buganda,” said Ham. “I cannot be seen quarrelling with Buganda over land. Even if I bought this land, I have lost interest in the land. I cannot go to court because it will sound like I am fighting with Kabaka.”

But things have now changed. And the Kabaka will now be facing his subject in a court of law soon.
