Robert Kyagulanyi aka Bobi Wine’s brother Fred Nyanzi has asked the High Court in Kampala to block Kampala Central MP Muhammad Nsereko’s swearing-in.
Nyanzi lost to Nsereko by just 1,023 votes in the January 14 election.
But he claimed the Electoral Commission (EC) rigged him out by falsifying results from at least 13 polling stations.
Yet he was unsuccessful when he presented this evidence before Mengo Chief Magistrates Court.
In January 2021, Mengo Chief Magistrate Esther Nansambu dismissed Nyanzi’s application, admitting it had no jurisdiction to handle the concerns raised.
Almost two months later, Nyanzi has now sued Nsereko, the EC and the Kampala Central returning officer.
Bobi Wine’s brother says electoral malpractices greatly affected the final outcome of the poll.
He claims there was a huge number of invalid votes, failure to include results from seven polling stations and forgery of declaration of results forms.
He also accuses Nsereko of using money to influence presiding officers and most of the electoral procedures in his favour.
“All these wrong postings and mathematical and arithmetical mistakes arose as a result of vote stuffing orchestrated by Nsereko personally and /or with his knowledge, consent and approval,” claimed Nsereko in his suit filed by Semuyaba, Iga and Company Advocates.
He also claims many ballots could have been erroneously counted as invalid.
“There was an overwhelming number of invalid votes because the counting went on past 6pm till late at night and during this time, one is bound to make numerous errors due to poor visibility, invalidating valid votes and vice versa.”
Nyanzi has made three prayers: overturning of Nsereko’s victory and his declaration as Kampala Central MP, a fresh recount or a new poll.
