Kampala Woman MP Nabilah Naggayi and her friend Prof Venansius Baryamureeba left the commercial division of the High Court in Kampala in tears after Justice Stephen Mubiru ruled against evicting Isaac Sempala from their house in Buziga.
Justice Mubiru ordered Pror Baryamureeba and Nabilah against throwing Sempala from the house until the main application has been disposed of.
Court will decide on the suit involving the three parties on May 19.
The court decision will determine if Baryamureeba and Nabilah take over the Buziga home to recover a Shs800m ‘friendly loan’ the former Makerere University vice chancellor extended to Nabilah and Sempala years ago, or if Sempala will be declared the rightful owner of the land.
Court will also determine if Nabilah illegally used the property comprised in LRV 4004 Kyadondo Block 273 Plot5 Katuso Close, Kampala, as collateral security for the friendly loan from Baryamureeba.
For months now, Nabilah and Sempala have engaged in dramatic cat-and-mouse chases fanned by court orders and counter orders.
Commenting on orders from Makindye Magistrate’s Court’s Lorna Tukundane that favoured Nabilah, Justice Mubiru wondered why the magistrate issued the orders yet Nabilah had agreed to vacate the house for Baryamureeba as early as March 07.
Magistrate Tukundane had issued the protection order against Sempala, and in favour of Nabilah, on March 04.
Sempala’s lawyers challenged Tukundane’s protection order.
And Justice Mubiru has ruled that neither party be thrown out of the house until the judgement on the main application.
